Safe Trading (Escrow) Service Terms

Section 1. Introduction and Agreement
1.1. These terms and conditions (referred to below as the “Terms”) govern the use of the Safe Trading (Escrow) service provided by Trustfone.
1.2. When a buyer and seller request and use this service, they are deemed to have read, understood, and accepted all of these Terms.
1.3. These Terms apply together with the general Terms of Service of the Trustfone Marketplace. Where there is any conflict, these Terms take precedence for matters relating to the Safe Trading service.
1.4. This service may be used by anyone who is at least 18 years old and has created an account on the Trustfone Marketplace app.
Section 2. Definitions

| Chat room | The chat room within the Trustfone Marketplace where the buyer and seller communicate |
| Credit | The internal service unit (credit points) of the Trustfone Marketplace |
| Business day | A day excluding Saturdays, Sundays, and public holidays |
| Item value | The final price confirmed and agreed by both the buyer and the seller |
Section 3. Requesting the Service and the Service Fee
3.1. To request the service, the buyer must pay 50 credits in advance.
3.2. These credits are non-refundable once the service has started. However, Trustfone will refund them in full in the following cases —
- (a) if Trustfone is unable to provide the service; or
- (b) if the trade fails because of a seller breach under Section 9.
3.3. If the seller does not accept the service request, the 50 credits are automatically returned to the buyer.
Section 4. Trustfone’s Role and Limitations
4.1. As soon as the service starts, a Trustfone admin joins the chat room where the buyer and seller are talking.
4.2. Trustfone acts only as a neutral intermediary. It is neither the owner of the item nor an agent of the seller or the buyer.
4.3. Trustfone does not advise on, negotiate, or intervene in the price of the item. Setting the price is solely the responsibility of the buyer and seller.
4.4. Trustfone is not responsible for whether the item’s value is appropriate or whether the price is fair.
4.5. The admin will act within the chat room only for the following matters —
- (a) informing and explaining each step of the process;
- (b) informing the parties of the inspection result;
- (c) overseeing the funds transfer and item delivery;
- (d) investigating and handling breaches of these Terms.
Section 5. Price Confirmation
5.1. The Safe Trading process begins only after both the buyer and seller have explicitly confirmed the price in the chat room.
5.2. The confirmed price is the Item value and is used as the basis for calculating the service fee.
5.3. If the price needs to be changed after confirmation, it must be re-confirmed in the chat room by mutual agreement. Price changes will not be accepted after the inspection is complete.
Section 6. Delivery of the Item by the Seller
6.1. Once the price is confirmed, the seller must send the item to the designated Trustfone Service Center within [3] business days.
6.2. Before sending the item, the seller must have completed the following —
- (a) restoring to factory settings (factory reset);
- (b) fully removing iCloud / Google accounts;
- (c) removing SIM cards and memory cards;
- (d) deleting personal data.
6.3. All accessories described in the listing (box, charging cable, documents, etc.) must be sent together with the item.
6.4. The seller bears the shipping cost of sending the item to the Service Center.
6.5. If the item is not delivered within the specified period, Trustfone may cancel the trade.
Section 7. Payment by the Buyer
7.1. Once the price is confirmed, the buyer must transfer the item value to Trustfone’s official bank account (or mobile wallet) within [3] business days.
7.2. Transfers must be made only to accounts officially announced by Trustfone. Trustfone is not responsible for transfers made to other accounts.
7.3. If unable to transfer within the specified time, the buyer must give advance notice and may obtain an extension by arrangement with the seller. The extension must not exceed [3] business days.
7.4. If no transfer is made at all within the specified days without advance notice, this trade is immediately cancelled.
7.5. Any transfer fee charged by the bank (or wallet) is borne by the buyer. The amount received in the Trustfone account must be the full item value.
Section 8. Item Inspection
8.1. As soon as the item arrives at the Service Center, a skilled mobile technician performs the following Basic Check. This check is included in the service fee and there is no additional cost.

8.2. The Basic Check is completed within [24] hours of the item’s arrival, and the result is shared with both the buyer and the seller in the chat room.
8.3. If the buyer wishes, they may request a Full Check at an additional cost. It covers whether the LCD is original or replaced, touch response, battery condition, performance, camera, sensors, network connectivity (SIM/WiFi/Bluetooth/GPS/NFC), fingerprint/face security, whether the storage capacity is genuine, and so on.
8.4. If the Basic Check result differs significantly from what was stated in the listing, the buyer may cancel the trade within [24] hours of being notified of the result. For such a cancellation, the seller bears the cost of returning the item.
8.5. The decision of the Trustfone Service Center regarding the inspection result is final.
Section 9. Seller’s Obligations and Consequences of Breach
9.1. Trustfone will immediately halt the trade when any one of the following applies —
- (a) the item is not free of legal issues (stolen, blacklisted, or illegally imported);
- (b) it differs greatly from the information listed on the Trustfone Marketplace;
- (c) it is being sold fraudulently by dishonest means;
- (d) the IMEI (or serial numbers) have been altered;
- (e) an item completely different from the one described in the listing is sent.
9.2. If any situation under Section 9.1 occurs —
- (a) the item is returned to the seller (except in matters requiring legal action);
- (b) the trade is cancelled from that point;
- (c) the full amount is refunded to the buyer;
- (d) the 50 credits paid by the buyer are refunded;
- (e) all return-shipping costs are borne by the seller;
- (f) the seller’s account is suspended temporarily or permanently.
9.3. If the item is found not to be free of legal issues, Trustfone may report the matter to the relevant authorities and may provide the necessary information.
Section 10. Successful Completion of the Trade
10.1. Once the Basic Check has passed and the buyer’s payment has been received, Trustfone delivers the item to the buyer (or notifies them to collect it in person).
10.2. The buyer must confirm receipt within [24] hours of receiving the item. If there is no response within the specified time, it is deemed automatically confirmed.
10.3. Once confirmed, Trustfone transfers the funds to the seller within [2] business days (after deducting the service fee).
Section 11. Cancellation and Return
11.1. As soon as a trade is cancelled, Trustfone returns the item (or funds) to the respective buyer/seller exactly as received.
11.2. The return is carried out within [3] business days of the cancellation notice.
11.3. Trustfone bears the cost of returning the item (or funds) up to MMK 10,000.
11.4. If the cost exceeds the set rate (MMK 10,000), the additional cost is borne by the respective buyer/seller.
11.5. In a cancellation caused by a seller breach under Section 9, the cost-bearing in Section 11.3 does not apply; all costs are borne by the seller.
Section 12. Service Fee
12.1. On successful completion of the trade, the seller must pay 2% (two percent) of the item value to Trustfone.
Example. If the item value is MMK 1,000,000, a service fee of MMK 20,000 is payable.
12.2. The service fee is deducted directly by Trustfone at the time the funds are transferred to the seller.
12.3. Apart from the item delivery cost, the buyer does not need to pay any additional service fee.
12.4. If the buyer collects the item in person from the Service Center, no additional service fee is payable.
12.5. If the trade is not successful, the 2% service fee is not charged.
Section 13. Dispute Resolution
13.1. If any dispute arises, the parties must raise it within [7] days through the chat room (or Trustfone’s official communication channel).
13.2. Trustfone decides based on both parties’ evidence, the chat-room records, and the Service Center’s inspection records.
13.3. Trustfone’s decision is final within this service. This does not restrict the parties’ right to pursue further action under the law.
13.4. Trustfone takes no responsibility whatsoever for agreements or payments made outside the chat room.
Section 14. Limitation of Liability
14.1. Trustfone’s liability shall in no circumstances exceed the item value.
14.2. Trustfone is not liable for future defects of the item, or for indirect loss arising from use of the item.
14.3. The Basic Check warrants only the items in Section 8.1. No warranty is given for items not on that list.
14.4. Trustfone is not liable for delays caused by force majeure — natural disasters, power/internet outages, government orders, banking suspensions, and the like.
Section 15. Protection of Personal Data
15.1. The Service Center acts only as necessary when inspecting the item and does not copy or store personal data held on the device.
15.2. The seller is responsible for deleting personal data under Section 6.2. Trustfone is not responsible for data sent without being deleted.
15.3. Chat-room records and inspection records are retained for [90] days for dispute resolution.
Section 16. General
16.1. Trustfone may amend these Terms at any time. Amendments will be announced on the Trustfone Marketplace and take effect from the date of announcement.
16.2. For trades already started before an amendment, the version in effect at the time of starting continues to apply.
16.3. If any provision of these Terms is held to be legally ineffective, the remaining provisions continue to apply.
16.4. These Terms are interpreted and carried out in accordance with the laws in force in the Republic of the Union of Myanmar.
